Rights of data subjects

NEODIAGNOSTICA S.L.U. informs users that they may exercise their rights of access, rectification, restriction, erasure, portability and objection to the processing of their personal data, as well as the right not to be subject to automated decisions, including profiling, before the Data Controller. Likewise, they may withdraw the consent given at any time.

Right of access

This is the user’s right to obtain confirmation as to whether their data is being processed and, where applicable, to know the specific personal data being processed and the legal information regarding such processing, including purposes, legal basis, retention periods, disclosures, origin of the data, among others.

Right of rectification

This is the right of the data subject to have inaccurate or incomplete data modified. In relation to the website, this may only be satisfied with regard to information that is under the control of the website, for example, deleting comments published on the website itself, images or web content where the user’s personal data appears.

The written request sent by the holder of the personal data, or data subject, requesting the exercise of rights must take the following into account:

• The applicant must be reliably identified. If there are doubts about the applicant’s identity, they will be asked to correct the request, for example by providing further information, such as their ID number, a copy of their identity document or the email address they provided.
• The request may be made by the legal or voluntary representative when they are duly identified and authorised by the data subject through express authorisation to exercise the personal rights regulated under personal data protection regulations.
• The request must specify the right or rights to be exercised. If it does not refer to a specific processing activity, a response will be provided in relation to all processing activities affecting their personal data. If information is requested regarding a specific processing activity, only information about that activity will be provided. If the request is made by phone, the user will be instructed to make it in writing and will be informed of how to do so and the address to which it must be sent. Information will never be provided by phone.
• A postal or email address for notification purposes must be provided.
• Supporting documents for the request must be provided where necessary.
• The applicant must use any means that allows proof of sending and receipt of the request.

Complaints before the supervisory authority
